How we collect, use and protect personal information.

JAP UK Holdings Ltd is an Appointed Representative of EFT Finance Limited, which is authorised and regulated by the Financial Conduct Authority, FRN 667290. EFT Finance Limited is an independent finance broker, company registration number 07215828, registered office: Solo House, The Courtyard, London Road, Horsham, West Sussex, RH12 1AT.
This Privacy Policy explains how we and potential lenders use the personal information you provide to us. Please share this policy with all directors and partners where applicable. Our legal basis for processing your information
Our legal basis for processing your information under UK data protection laws is legitimate interests. You provide us with your information so that we may help find suitable finance options for your needs.
We may ask if you have any personal circumstances which may affect your finance journey. Any information you give us and the lender(s) will help us support you better. We would need your consent to record this information and to pass it to any potential lender we contact for you. If you prefer to tell the lender directly, we can provide the lender’s contact details.
We may also use data you give us, or data we receive from a specialist data broking service, to send you direct marketing about our finance broking services. Our legal basis for direct marketing is legitimate interests.
What information we may need from you
Examples of information we may ask you to provide include your full name and home address, date of birth, a copy of your passport or driving licence, a recent utility bill showing your home address, details of your personal means and liabilities, and any additional support you may need.
Information from other sources
We may obtain information from other sources, including Companies House, your website and social media, specialist providers of company credit analysis, specialist data broking services and publicly available or updated DVSA operator licence data.
How we use your information
We use customer relationship management tools to record information such as your contact details, details of promotional material you may have received, and whether you have asked not to receive further promotional material from us.
We will pass your information to potential lender(s). Please contact us or EFT Finance Limited’s Data Protection Officer at compliance@eftfinance.co.uk if you would like to know which potential lenders we approached on your behalf. EFT Finance Limited strongly recommends that you review the privacy notices on the websites of any lenders approached on your behalf.
We will never sell your information to third parties for marketing purposes.
Potential lenders and credit reference agencies
To process your application, potential lender(s) may perform credit and identity checks on you and your business partners. They may send information about your application to one or more Credit Reference Agencies (CRAs). The lender will use information provided by CRAs to check the data you have provided, assess creditworthiness and, where necessary, prevent criminal activity.
CRAs will record information about you, your business and its proprietors that they receive from potential lenders. When a CRA receives a search from a potential lender, it may place a footprint on your credit file which may be seen by other lenders. If you are a director, lenders may search you as an individual and in your role as director or guarantor.
If you make a joint application or tell us that you have a spouse or financial associate, you should discuss your credit requirements with them before we send the application to a lender, as CRAs may link your records together.
If you borrow from a lender, details of your accounts and how you manage them may be passed to CRAs. If you do not repay in full and on time, CRAs may record the outstanding debt and supply this information to other organisations or fraud prevention agencies. This information may remain on CRA records for six years after your credit agreement has ended.
If you provide false or inaccurate information and fraud is suspected, this may be recorded and passed to fraud prevention agencies and other organisations. If your request for funding is declined by a lender, the decline may be recorded on your credit record.
Credit reference agency information
Finance companies use different CRAs. You can read more about the main CRAs and their data protection policies through the Credit Reference Agency Information Notice (CRAIN):
Direct marketing
Where you receive direct marketing communication from us, we will give you the opportunity to opt out of receiving further direct marketing from us. We check information obtained from specialist data brokers against the Telephone Preference Service, Corporate Telephone Preference Service and our Do Not Contact list. You have the right to object to the processing of your information for direct marketing purposes.
How long we store your information
We store your information in our live systems for six years from the end of our contact with you or the end of your last credit agreement, whichever is longer. We keep information obtained from specialist data brokers for two years in our live systems, unless you become a customer.
Information may also be stored in encrypted back-ups held in a secure off-site location and accessed only for business continuity purposes. Information is deleted from back-ups 10 years after the last processing of your information. It is not currently technically possible to delete individual records from encrypted back-ups.
Your information security
We take steps to protect your personal data against loss or theft, unauthorised access, disclosure, copying, use or alteration.
Your rights
You have the right to request a copy of information held about you. You also have the right to ask us to update, correct or remove information you think is inaccurate or incomplete. Where you ask for changes to the information we hold, we will also tell any lenders who hold your information.
You can ask us to delete your information. We will remove your information from live systems within one month of receiving a valid request. Due to the way information is stored in encrypted back-ups, it may not be possible to delete your information from back-ups as quickly as from live systems.
You can object to processing based on legitimate interests. We will stop processing your credit application unless there are legitimate reasons to continue, such as the exercise or defence of legal claims.
You can withdraw consent for our processing of information relating to any additional support needs you may have. We will continue to process your application without that additional information and will advise any lender to whom we have sent your application that you have withdrawn consent.
